Wow, this is a tough one.
Should divorces be made more civil, or does the potential of having to wrangle things out with an attorney dissuade some couples from seeking a divorce?
Back in the early 1970s when no-fault divorce was introduced, it was billed as a way to dissolve a marriage without all the legal wrangling and the burden of proving that someone had done someone else wrong. Now, 35 years later, divorces are still messy, drawn out and expensive.
So some attorneys are offering an option called collaborative divorces in which his and hers attorneys sit down with the Mr. and Mrs. and peacefully work out a settlement that makes everybody relatively happy. The practice was even recently endorsed by the American Bar Association. The lawyers pledge to work together, as do the soon-to-be-former-couple.
